Experienced Representation in Drafting Prenuptial and Postnuptial Agreements

Florida is a no-fault state and as a result it is often difficult to predict how your marital assets are going to be divided as the standard is equitable distribution and not a 50/50 division. A prenuptial agreement is an enforceable contract which allows each spouse to clearly delineate on their terms what will happen to their respective assets and debts, as well as protect their children from a previous marriage, if they were to later divorce. It also serves to protect the spouses from needless and costly litigation in the event of a divorce.

A prenuptial agreement should be signed at least thirty (30) days prior to the wedding and also provide for how debts will be distributed, what alimony if any will be paid, and to which heirs assets will be transferred. If a signed prenuptial agreement was based on fraud or nondisclosure of finances by either party, or if the prenuptial agreement was the signed under duress, misrepresentation or was otherwise unconscionable, it may be rendered void by the Court.

A postnuptial agreement operates in a similar fashion as the prenuptial agreement but is executed after the marriage date and can add additional protection to the spouses.
