Baby Boomer Divorce Rate Increasing

Although divorce rates are decreasing across the nation, an interesting trend is emerging: divorce rates among baby boomers are on the rise. This group alone, composed of individuals ranging in age from their late forties to late sixties, is now responsible for one in four divorces.
This rate continues to grow, and women claim to initiate over 66 percent of these divorces, according to a survey conducted by AARP.
What is fueling the increase? Experts speculate this empowered generation of women famous for shattering social mores in the past is prepared to do it again, all in the pursuit of happiness.
Factors Contributing to Divorce Among Boomer Women
Researchers found traditional moral taboos against divorce no longer held troubled marriages together; instead children were serving as the glue. Once baby boomer women become empty nesters, they often take a step back and reevaluate their marriages.
An increasing rate of these boomer women are not happy with what they see. They often have careers and feel financially secure enough to walk away from an unsatisfying relationship.

Scarlett Johansson Sheds Some Light on Reynolds Divorce

Divorce affects everyone; even the superheroes of the silver screen.  Nearly a year and a half after Scarlett Johansson’s divorce from Ryan Reynolds, she opened up in the May issue of Vogue Magazine on her private marriage and equally private divorce.  “It was devastating. It really throws you. You think that your life is going to be one way, and then, for various reasons or whatever, it doesn’t work out.”

While it does take some time, there is light at the end of the tunnel.  Scarlett comments that her work in the movie We Bought a Zoo was comforting; something needed to begin the healing process.  She has been dating Sean Penn.  So fear not, this may just be an opportunity for you to learn more about yourself and perhaps find the person who truly completes you.

In Age of Dual Incomes, Alimony Payers Prod States to Update Laws

MIAMI — In the waning days of this year’s legislative session, Florida lawmakers and advocacy groups are pushing to overhaul the state’s alimony law in a bid to better reflect today’s marriages and make the system less burdensome for the alimony payer.

Dr. Jose A. Aleman-Gomez said his former wife had a solid income as a dentist.

Florida joins a grass-roots movement in a growing number of states that seeks to rewrite alimony laws by curbing lifelong alimony and alleviating the financial distress that some payers — still mostly men — say they face. The activists say the laws in several states, including Florida, unfairly favor women and do not take into account the fact that a majority of women work and nearly a third have college degrees

Child Support Orders and Payments In Florida

A child support order tells the parents what they must do to support their children. Enforcing child support orders means getting the parent to do what the order says.
The amount of child support is based on guidelines defined in Florida law. Child support guidelines are standards used to figure out the support needed for a child and the amount a parent has to pay. Guidelines help make sure support amounts are fair. Every state has guidelines, but they may be different in each state.
These guidelines are used the first time child support is ordered and every time the child support amount changes. They are also used to review the order to see if the support amount should be changed.
Child support guidelines consider:

  • The income of both parents
  • The child’s health care and child care costs
  • The standard needs for the child. A list of support amounts based on the child’s age and net income of the parents is in the Florida law – standard needs table.

Signing a prenup: In case ‘I do’ becomes ‘I don’t’

Although prenuptial agreements are often associated with celebrity couples — and their headline-generating divorces — they’re not just for boldface names.

Any couple who brings personal or business assets to the marriage can benefit from a prenup. The most basic of these contracts lists an inventory of premarital assets that in the event of a divorce will remain the property of their original owner.
“Prenups are good because they preserve the expectations of the parties and prevent surprises in a divorce trial,” says attorney Bob Nachshin, a partner in family law firm Nachshin & Langlois LLP in Los Angeles, and co-author of “I Do, You Do … But Just Sign Here: A Quick and Easy Guide to Cohabitation, Prenuptial and Postnuptial Agreements.” “In my 34 years of practice, I’ve never seen a prenuptial agreement that wasn’t enforced by the court.”

Is your company adoption-friendly?

Is your company adoption-friendly? The Dave Thomas Foundation for Adoption is compiling its annual list of companies that provide the best adoption benefits across the U.S.

“We want companies across America to tell us why they are adoption-friendly and participate in our sixth annual 100 Best Adoption-Friendly Workplaces survey,” said Rita Soronen, president and CEO of the Foundation. “The list allows us to honor these adoption-friendly workplaces, and let others know how easy and cost-effective it is to offer adoption benefits to employees.”
The 2012 application deadline is Monday, April 30. The Foundation’s list of the nation’s 100 Best Adoption-Friendly Workplaces is released in September and featured in Employee Benefit News magazine. The list is determined by an analysis of a company’s adoption benefits, including the maximum amount of financial reimbursement and paid leave for families who adopt.

Establishing Legal Paternity

Establishing Legal Paternity

Paternity is Fatherhood

Every child deserves to have a legal father.  When you establish paternity, you identify the legal father of the child.  Paternity gives rights and benefits to the mother, the father and the child.
Some of the rights and benefits for the child are:
  • Information on family medical history
  • The child knows who their father is
  • The father’s name is on the birth certificate
  • Health or life insurance from either parent, if available
  • Support from both parents, like child support and medical support
  • Get Social Security or veteran’s benefits, military allowances and inheritances.
Paternity gives both parents the legal right to:
  • Get a child support order
  • Get a court order for visitation or custody
  • Have a say in legal decisions about the child
